1. 接受本协议

本用户协议（下称「本协议」）是你与 Lu Li（下称「我们」或「开发者」）之间就使用 TV Remote 移动应用及其更新、功能与内容（下称「本 App」）达成的法律协议。

下载、安装或使用本 App，即表示你同意本协议及我们的隐私政策。若不同意，请勿使用并删除本 App。

2. 使用资格

你须年满 13 周岁（EEA / 英国为 16 周岁）。未成年人须在父母或监护人参与下使用本 App。

3. 本 App 能做什么、不能做什么

TV Remote 在你的 iPhone 或 iPad 上通过家庭 Wi-Fi 遥控电视：

仅支持部分电视 本 App 只支持三星 Tizen 与 LG webOS 智能电视，不是万能遥控器。功能取决于电视型号、固件与当前输入源，某些按键可能无效。
不能开机 本版本无法通过网络打开电视。网络唤醒与部分旧型号需要的发现方式，需要本构建暂不具备的系统能力。连接时电视必须已经开机。
需要同一网络与本地网络权限 手机与电视必须在同一 Wi-Fi，且允许本地网络访问；访客网络、AP 隔离或防火墙会阻止连接。
配对由电视控制 首次连接必须在电视上用其遥控器确认。电视固件更新、恢复出厂设置或移除授权设备后，需要重新配对。
依赖电视厂商的接口 本 App 使用公开的局域网控制方式，未使用厂商官方 SDK。厂商修改协议或固件可能导致部分功能失效。

4. Apple App Store 附加条款

本协议仅存在于你与开发者之间，与 Apple 无关。Apple 不对本 App 或其内容负责。由于你从 Apple App Store 获取本 App，以下条款适用：

  1. 许可范围。 第 5 条授予的许可仅限于你在拥有或控制的 Apple 品牌设备上、按 Apple 媒体服务条款中的使用规则使用本 App。
  2. 维护与支持。 开发者（而非 Apple）独自负责本 App 的维护与支持。Apple 无提供维护或支持的义务。
  3. 保证。 开发者独自对法律未有效排除的任何明示或默示产品保证负责。若本 App 不符合适用保证，你可通知 Apple，Apple 将退还本 App 的购买价款（如有）。在法律允许的最大范围内，Apple 不承担其他保证义务。
  4. 产品责任请求。 开发者（而非 Apple）负责处理与本 App 或你持有、使用本 App 有关的请求，包括产品责任、不符合法律或监管要求，以及消费者保护、隐私或类似法律项下的请求。
  5. 知识产权请求。 若第三方主张本 App 或你对它的持有与使用侵犯其知识产权，开发者（而非 Apple）独自负责调查、抗辩、和解与解决。
  6. 法律合规。 你声明并保证你不位于受美国政府禁运或被指定为「支持恐怖主义」的国家，也不在任何美国政府的禁止或限制方名单上。
  7. 第三方受益人。 Apple 及其子公司是本协议的第三方受益人，在你接受本协议后，有权（并被视为已接受该权利）对你执行本协议。
  8. 出口。 你须遵守适用的出口管制与制裁法律，不得在禁止的司法管辖区或用于禁止用途。
  9. 美国政府最终用户。 本 App 属于 48 C.F.R. §2.101 定义的「商业项目」，由「商业计算机软件」与「商业计算机软件文档」组成，仅作为商业项目授权给美国政府最终用户，权利与其他最终用户相同。

Apple 的标准最终用户许可协议（apple.com/legal/internet-services/itunes/dev/stdeula）在与本协议不冲突的范围内并入本协议。

5. 许可与限制

在遵守本协议的前提下，我们授予你个人的、有限的、非独占的、不可转让的、可撤销的许可，允许你在拥有或控制的 Apple 设备上使用本 App。

你不得：

若你严重违反本协议，我们可暂停或终止你的使用许可。

6. 你的责任

你负责确保你有权控制所连接的电视，并对通过本 App 发出的操作负责（例如录制、购买或更改电视设置）。本 App 只转发你的操作，不参与电视端的账户、购买或内容决定。

本版本没有 App 内购买，也不收费。我们不处理支付，也没有订阅或恢复购买事项。若未来引入付费功能，我们会在购买前于 App 内明确显示价格与条款。

8. 免费功能

本 App 的全部功能当前免费提供，不设次数限制。

9. 知识产权与商标

本 App 及其软件、设计、文字与图形归开发者或其许可方所有，受著作权及其他法律保护。本协议仅授予第 5 条的有限许可。

「TV Remote」是我们使用的名称。Samsung、Tizen、LG、webOS 及相关名称与标识是其各自所有者的商标。本 App 是独立产品，与三星、LG 没有关联，也未获其赞助或背书。电视上显示的应用名称与图标归其各自所有者；本 App 仅按电视提供的信息显示它们。

Apple、iPhone、iPad 与 App Store 是 Apple Inc. 的商标。

10. 反馈

若你向我们发送建议或反馈，你授予我们非独占、永久、免许可费、全球范围的许可，用于使用与整合该反馈，无需补偿或署名。请勿发送机密信息。

11. 隐私

我们的隐私政策说明本 App 在你的设备上处理哪些数据、哪些数据会离开设备。使用本 App 即表示你知悉该政策。要点是：遥控指令只在局域网内传输。

12. 免责声明

在法律允许的最大范围内，本 App 按「现状」和「现有」提供，不作任何明示或默示保证，包括适销性、特定用途适用性、不侵权，以及不间断或无错误运行。

我们不保证：

部分司法管辖区不允许排除某些保证，上述部分内容可能不适用于你。

13. 责任限制

在法律允许的最大范围内，开发者不对任何间接、附带、特殊、后果性、惩罚性损害负责，也不对任何数据、利润、商誉或商业机会的损失负责，无论是否已被告知该可能性。

在法律允许的最大范围内，开发者就本 App 的全部赔偿责任累计不超过 (a) 你在索赔前 12 个月内为本 App 支付的金额，或 (b) 10 美元，以较高者为准。

本协议不限制依法不能限制的责任，也不影响你作为消费者的强制性法定权利。

14. 赔偿

在法律允许的范围内，你同意就因你违反本协议、滥用本 App，或未经授权控制他人电视、干扰他人网络而产生的索赔、损害、损失与费用（含合理律师费），向开发者作出赔偿并使其免受损害。

15. 终止

你可随时停止使用并删除本 App。若你违反本协议或我们停止提供本 App，我们可暂停或终止许可。终止后第 5 条许可结束；第 4、9、12、13、14、17、18 条继续有效。除法律或 Apple 退款政策要求外，终止不产生退款。

16. 本 App 与协议的变更

我们可能不时更新本 App 与本协议。更新后的协议会标注新的「最后更新」日期；重大变更会在生效前于 App 内或本页说明。生效日之后继续使用即表示你接受更新后的协议；如不同意，请停止使用并删除本 App。

17. 适用法律与争议解决

本协议适用中华人民共和国法律，不适用冲突法规则。除下段另有约定外，中华人民共和国法院对本协议或本 App 引起的争议具有专属管辖权。

本节不剥夺你所在国家强制性消费者法律给予你的保护，也不剥夺法律赋予你在当地法院起诉的权利。提起诉讼前，请先通过 support@gougou.me 联系我们，以便尝试友好解决。

1. Agreement to these Terms

These Terms of Use ("Terms") are a legal agreement between you and Lu Li ("we", "us", "the Developer"), governing your use of the TV Remote mobile application and any updates, features or content we make available through it (the "App").

By downloading, installing or using the App, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the App and delete it.

2. Eligibility

You must be at least 13 years old (16 in the EEA/UK) to use the App. If you are a minor, you may use the App only with the involvement of a parent or guardian.

3. What the App does — and what it does not

TV Remote controls a TV from your iPhone or iPad over your home Wi-Fi:

Only some TVs are supported The App supports Samsung Tizen and LG webOS smart TVs only; it is not a universal remote. Features depend on the TV model, firmware and current input, and some keys may do nothing.
The App cannot turn the TV on This version cannot power on a TV over the network: wake-on-LAN and the discovery some older models need require system capabilities this build does not include. The TV must already be on when you connect.
Same network and Local Network permission required The phone and TV must be on the same Wi-Fi, with local network access allowed; guest networks, AP isolation and firewalls block the connection.
The TV controls pairing The first connection must be approved with the TV's own remote. A firmware update, factory reset or removing the authorised device requires pairing again.
It relies on TV-maker interfaces The App uses publicly documented local-network control methods rather than a vendor SDK. If a manufacturer changes its protocol or firmware, some features may stop working.

4. Apple App Store additional terms

These Terms are between you and the Developer only, not with Apple. Apple is not responsible for the App or its content. The following applies because you obtained the App from the Apple App Store:

  1. Scope of licence. The licence granted in §5 is limited to a non-transferable licence to use the App on Apple-branded devices that you own or control, as permitted by the Usage Rules in the Apple Media Services Terms and Conditions.
  2. Maintenance and support. The Developer, not Apple, is solely responsible for providing any maintenance and support services for the App. Apple has no obligation to furnish any maintenance or support.
  3. Warranty. The Developer is solely responsible for any product warranties, whether express or implied by law, to the extent not effectively disclaimed. If the App fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any) for the App. To the maximum extent permitted by law, Apple has no other warranty obligation with respect to the App.
  4. Product claims. The Developer, not Apple, is responsible for addressing any claims relating to the App or your possession and/or use of it, including product liability claims, claims that the App fails to conform to any applicable legal or regulatory requirement, and claims arising under consumer protection, privacy or similar legislation.
  5. Intellectual property claims. In the event of a third-party claim that the App or your possession and use of it infringes that third party's intellectual property rights, the Developer, not Apple, will be solely responsible for the investigation, defence, settlement and discharge of the claim.
  6. Legal compliance. You represent and warrant that you are not located in a country subject to a U.S. Government embargo or designated by the U.S. Government as a "terrorist supporting" country, and that you are not listed on any U.S. Government list of prohibited or restricted parties.
  7. Third-party beneficiary. Apple and its subsidiaries are third-party beneficiaries of these Terms and, upon your acceptance, will have the right (and will be deemed to have accepted the right) to enforce these Terms against you.
  8. Export. You must comply with applicable export control and sanctions laws and may not use the App in any prohibited jurisdiction or for any prohibited purpose.
  9. U.S. Government end users. The App is a "Commercial Item" as defined in 48 C.F.R. §2.101, consisting of "Commercial Computer Software" and "Commercial Computer Software Documentation". It is licensed to U.S. Government end users only as Commercial Items and with only those rights granted to all other end users.

Apple's standard Licensed Application End User License Agreement (apple.com/legal/internet-services/itunes/dev/stdeula) is incorporated by reference to the extent it applies and does not conflict with these Terms.

5. Licence and restrictions

Subject to these Terms, we grant you a personal, limited, non-exclusive, non-transferable, revocable licence to use the App on Apple devices you own or control.

You may not:

6. Your responsibilities

You are responsible for ensuring you are entitled to control the TV you connect, and for the actions you send through the App (for example recording, buying or changing TV settings). The App only forwards your actions; it plays no part in TV-side accounts, purchases or content decisions.

This version has no in-app purchases and is free. We process no payments, and there are no subscriptions or restores. If paid features are introduced later, the price and terms will be shown in the App before you confirm a purchase.

All current features are free with no usage limits.

9. Intellectual property and trademarks

The App, including its software, design, text and graphics, is owned by the Developer or its licensors and is protected by copyright and other laws. These Terms do not grant you any rights other than the limited licence in §5.

"TV Remote" is a name used by us. Samsung, Tizen, LG, webOS and related names and logos are trademarks of their respective owners. The App is an independent product, not affiliated with, sponsored or endorsed by Samsung or LG. App names and icons shown on a TV belong to their respective owners; the App only displays what the TV reports.

Apple, iPhone, iPad and App Store are trademarks of Apple Inc.

10. Feedback

If you send us suggestions or feedback, you grant us a non-exclusive, perpetual, royalty-free, worldwide licence to use and incorporate it without compensation or attribution. Do not send us confidential information.

11. Privacy

Our Privacy Policy explains what the App processes on your device and what leaves it. By using the App you acknowledge that policy. The key point: commands stay on your local network.

12. Disclaimer of warranties

To the maximum extent permitted by law, the App is provided "AS IS" and "AS AVAILABLE", without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, non-infringement, and uninterrupted or error-free operation.

We do not warrant that:

Some jurisdictions do not allow the exclusion of certain warranties, so some of the above may not apply to you.

13. Limitation of liability

To the maximum extent permitted by law, the Developer will not be liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for any loss of data, profits, goodwill or business opportunity, arising out of or related to your use of or inability to use the App, even if advised of the possibility.

To the maximum extent permitted by law, the Developer's total aggregate liability for all claims relating to the App will not exceed the greater of (a) the amount you paid for the App in the 12 months preceding the claim, or (b) USD 10.

Nothing in these Terms limits liability that cannot be limited by law, or your mandatory statutory rights as a consumer.

14. Indemnity

To the extent permitted by law, you agree to indemnify and hold harmless the Developer from claims, damages, losses and expenses (including reasonable legal fees) arising from your breach of these Terms, your misuse of the App, or your unauthorised control of another person's TV or interference with their network.

15. Termination

You may stop using the App and delete it at any time. We may suspend or terminate the licence if you breach these Terms or if we discontinue the App. On termination, the licence in §5 ends; §§4, 9, 12, 13, 14, 17 and 18 survive. Termination does not entitle you to a refund except where required by law or by Apple's refund policy.

16. Changes to the App and these Terms

We may update the App and these Terms from time to time. We will post the updated Terms with a new "Last updated" date and, for material changes, describe them in the App or on this page before they take effect. If you continue to use the App after the effective date, you accept the updated Terms.

17. Governing law and disputes

These Terms are governed by the laws of the People's Republic of China, without regard to conflict-of-law rules. Subject to the paragraph below, the courts of the People's Republic of China have exclusive jurisdiction over disputes arising from these Terms or the App.

Nothing in this section deprives you of the protection of mandatory consumer laws in your country of residence, or of your right to bring a claim in your local courts where the law gives you that right. Before filing a claim, please contact us at support@gougou.me so we can try to resolve the issue informally.
