1. 接受本协议
本用户协议（下称「本协议」）是你与 Lu Li（下称「我们」或「开发者」）之间就使用 Msg Archive 移动应用及其更新、功能与内容（下称「本 App」）达成的法律协议。
下载、安装或使用本 App，即表示你同意本协议及我们的隐私政策。若不同意，请勿使用并删除本 App。
2. 使用资格
你须年满 13 周岁（EEA / 英国为 16 周岁）。未成年人须在父母或监护人参与下使用本 App。
3. 本 App 能做什么、不能做什么
Msg Archive 在你的 iPhone 上建立并管理聊天归档：
- 导入聊天导出文件（.txt / .zip），包括附件配对与多行消息；
- 在没有导出功能时，用截图在本机识别文字、按顺序拼接并标记缺口；
- 全文检索，并按对话、发送者与日期筛选；
- 导出气泡版式或纯文本 PDF、CSV、纯文本，并附完整性报告；
- 以 AES-256-GCM 加密备份，并可在需要时校验与恢复。

4. Apple App Store 附加条款
本协议仅存在于你与开发者之间，与 Apple 无关。Apple 不对本 App 或其内容负责。由于你从 Apple App Store 获取本 App，以下条款适用：
- 许可范围。 第 5 条授予的许可仅限于你在拥有或控制的 Apple 品牌设备上、按 Apple 媒体服务条款中的使用规则使用本 App。
- 维护与支持。 开发者（而非 Apple）独自负责本 App 的维护与支持。Apple 无提供维护或支持的义务。
- 保证。 开发者独自对法律未有效排除的任何明示或默示产品保证负责。若本 App 不符合适用保证，你可通知 Apple，Apple 将退还本 App 的购买价款（如有）。在法律允许的最大范围内，Apple 不承担其他保证义务。
- 产品责任请求。 开发者（而非 Apple）负责处理与本 App 或你持有、使用本 App 有关的请求，包括产品责任、不符合法律或监管要求，以及消费者保护、隐私或类似法律项下的请求。
- 知识产权请求。 若第三方主张本 App 或你对它的持有与使用侵犯其知识产权，开发者（而非 Apple）独自负责调查、抗辩、和解与解决。
- 法律合规。 你声明并保证你不位于受美国政府禁运或被指定为「支持恐怖主义」的国家，也不在任何美国政府的禁止或限制方名单上。
- 第三方受益人。 Apple 及其子公司是本协议的第三方受益人，在你接受本协议后，有权（并被视为已接受该权利）对你执行本协议。
- 出口。 你须遵守适用的出口管制与制裁法律，不得在禁止的司法管辖区或用于禁止用途。
- 美国政府最终用户。 本 App 属于 48 C.F.R. §2.101 定义的「商业项目」，由「商业计算机软件」与「商业计算机软件文档」组成，仅作为商业项目授权给美国政府最终用户，权利与其他最终用户相同。
Apple 的标准最终用户许可协议（apple.com/legal/internet-services/itunes/dev/stdeula）在与本协议不冲突的范围内并入本协议。
5. 许可与限制
在遵守本协议的前提下，我们授予你个人的、有限的、非独占的、不可转让的、可撤销的许可，允许你在拥有或控制的 Apple 设备上使用本 App。
你不得：
- 复制、修改、翻译、反向工程、反编译或反汇编本 App，法律强制允许的除外；
- 出租、出借、再许可、分发或转售本 App；
- 删除或更改所有权声明；
- 在无权访问他人设备或账号的情况下获取其聊天内容；
- 使用本 App 骚扰、威胁、跟踪他人，或侵犯他人的隐私、通信秘密或其他权利；
- 把导出的文件或完整性报告当作虚假证据使用；
- 以违反适用法律、消息服务条款或 Apple 条款的方式使用本 App。
若你严重违反本协议，我们可暂停或终止你的使用许可。
6. 你的内容与责任
你保留对归档、导出文件与备份的全部权利。你仅授予我们在你使用相关功能时所必需的、限于本机的许可。由于处理都在你的设备上完成，我们不会收到你的内容。
你负责：
- 确认你有权保存、处理、导出与分享归档中的内容，包括他人的个人信息；
- 遵守当地关于通信记录、隐私与数据保护的法律；
- 核对由截图重建的消息，并在重要用途前验证准确性；
- 妥善保管备份口令，并把备份保存在可信位置；
- 妥善保管设备密码，尤其是在开启应用锁时。
7. 购买
本版本没有 App 内购买，也不收费。我们不处理支付，也没有订阅或恢复购买事项。若未来引入付费功能，我们会在购买前于 App 内明确显示价格与条款。
8. 免费功能
本 App 的全部功能当前免费提供，不设次数限制。
9. 知识产权与商标
本 App 及其软件、设计、文字与图形归开发者或其许可方所有，受著作权及其他法律保护。本协议仅授予第 5 条的有限许可。
「Msg Archive」是我们使用的名称。WhatsApp、iMessage、SMS 及其他消息服务的名称与标识是其各自所有者的商标。本 App 是独立产品，与任何消息服务均无关联，也未获其赞助或背书。归档中的内容（包括头像、图片与文字）的权利归其各自所有者。
Apple、iPhone 与 App Store 是 Apple Inc. 的商标。
10. 反馈
若你向我们发送建议或反馈，你授予我们非独占、永久、免许可费、全球范围的许可，用于使用与整合该反馈，无需补偿或署名。请勿发送真实聊天内容。
11. 隐私
我们的隐私政策说明本 App 在你的设备上处理哪些数据、哪些数据会离开设备。使用本 App 即表示你知悉该政策。要点是：消息永不离开这台设备，除非你自己导出或分享。
12. 免责声明
在法律允许的最大范围内，本 App 按「现状」和「现有」提供，不作任何明示或默示保证，包括适销性、特定用途适用性、不侵权，以及不间断或无错误运行。
我们不保证：
- 导入或识别结果完整、准确，或与原始聊天完全一致；
- 导出文件具有任何法律效力或会被任何机构接受；
- 备份一定可恢复，或能防止任何数据丢失；
- 本 App 与所有 iOS 版本或导出格式兼容。
部分司法管辖区不允许排除某些保证，上述部分内容可能不适用于你。
13. 责任限制
在法律允许的最大范围内，开发者不对任何间接、附带、特殊、后果性、惩罚性损害负责，也不对任何数据、归档、消息、利润、商誉或商业机会的损失负责，无论是否已被告知该可能性。
在法律允许的最大范围内，开发者就本 App 的全部赔偿责任累计不超过 (a) 你在索赔前 12 个月内为本 App 支付的金额，或 (b) 10 美元，以较高者为准。
本协议不限制依法不能限制的责任，也不影响你作为消费者的强制性法定权利。
14. 赔偿
在法律允许的范围内，你同意就因你违反本协议、滥用本 App，或在无权处理的情况下归档、导出他人通信内容而产生的索赔、损害、损失与费用（含合理律师费），向开发者作出赔偿并使其免受损害。
15. 终止
你可随时停止使用并删除本 App。若你违反本协议或我们停止提供本 App，我们可暂停或终止许可。终止后第 5 条许可结束；第 4、9、12、13、14、17、18 条继续有效。除法律或 Apple 退款政策要求外，终止不产生退款。
16. 本 App 与协议的变更
我们可能不时更新本 App 与本协议。更新后的协议会标注新的「最后更新」日期；重大变更会在生效前于 App 内或本页说明。生效日之后继续使用即表示你接受更新后的协议；如不同意，请停止使用并删除本 App。
17. 适用法律与争议解决
本协议适用中华人民共和国法律，不适用冲突法规则。除下段另有约定外，中华人民共和国法院对本协议或本 App 引起的争议具有专属管辖权。
本节不剥夺你所在国家强制性消费者法律给予你的保护，也不剥夺法律赋予你在当地法院起诉的权利。提起诉讼前，请先通过 support@gougou.me 联系我们，以便尝试友好解决。
18. 其他
- 完整协议。 本协议与隐私政策构成你与我们之间关于本 App 的完整协议。
- 可分割性。 若任何条款被认定无效，其余条款继续完全有效。
- 不弃权。 我们未执行某条款不构成对该条款的弃权。
- 转让。 你不得转让本协议；我们可转让给关联公司或承继方。
- 语言。 本协议提供英文与中文版本。如两者冲突，在适用法律允许的范围内以英文版本为准。
- Apple。 除第 4 条所述外，Apple 不是本协议的当事方。

1. Agreement to these Terms
These Terms of Use ("Terms") are a legal agreement between you and Lu Li ("we", "us", "the Developer"), governing your use of the Msg Archive mobile application and any updates, features or content we make available through it (the "App").
By downloading, installing or using the App, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the App and delete it.
2. Eligibility
You must be at least 13 years old (16 in the EEA/UK) to use the App. If you are a minor, you may use the App only with the involvement of a parent or guardian.
3. What the App does — and what it does not
Msg Archive builds and manages a private chat archive on your iPhone:
- import chat export files (.txt / .zip), pairing attachments and handling multi-line messages;
- when no export exists, recognize text from screenshots on the device, stitch them in order and flag gaps;
- search everything, and filter by conversation, sender and date;
- export chat-bubble or transcript PDFs, CSV or plain text, with an integrity report;
- create AES-256-GCM encrypted backups, and verify or restore them when needed.

4. Apple App Store additional terms
These Terms are between you and the Developer only, not with Apple. Apple is not responsible for the App or its content. The following applies because you obtained the App from the Apple App Store:
- Scope of licence. The licence granted in §5 is limited to a non-transferable licence to use the App on Apple-branded devices that you own or control, as permitted by the Usage Rules in the Apple Media Services Terms and Conditions.
- Maintenance and support. The Developer, not Apple, is solely responsible for providing any maintenance and support services for the App. Apple has no obligation to furnish any maintenance or support.
- Warranty. The Developer is solely responsible for any product warranties, whether express or implied by law, to the extent not effectively disclaimed. If the App fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any) for the App. To the maximum extent permitted by law, Apple has no other warranty obligation with respect to the App.
- Product claims. The Developer, not Apple, is responsible for addressing any claims relating to the App or your possession and/or use of it, including product liability claims, claims that the App fails to conform to any applicable legal or regulatory requirement, and claims arising under consumer protection, privacy or similar legislation.
- Intellectual property claims. In the event of a third-party claim that the App or your possession and use of it infringes that third party's intellectual property rights, the Developer, not Apple, will be solely responsible for the investigation, defence, settlement and discharge of the claim.
- Legal compliance. You represent and warrant that you are not located in a country subject to a U.S. Government embargo or designated by the U.S. Government as a "terrorist supporting" country, and that you are not listed on any U.S. Government list of prohibited or restricted parties.
- Third-party beneficiary. Apple and its subsidiaries are third-party beneficiaries of these Terms and, upon your acceptance, will have the right (and will be deemed to have accepted the right) to enforce these Terms against you.
- Export. You must comply with applicable export control and sanctions laws and may not use the App in any prohibited jurisdiction or for any prohibited purpose.
- U.S. Government end users. The App is a "Commercial Item" as defined in 48 C.F.R. §2.101, consisting of "Commercial Computer Software" and "Commercial Computer Software Documentation". It is licensed to U.S. Government end users only as Commercial Items and with only those rights granted to all other end users.
Apple's standard Licensed Application End User License Agreement (apple.com/legal/internet-services/itunes/dev/stdeula) is incorporated by reference to the extent it applies and does not conflict with these Terms.
5. Licence and restrictions
Subject to these Terms, we grant you a personal, limited, non-exclusive, non-transferable, revocable licence to use the App on Apple devices you own or control.
You may not:
- copy, modify, translate, reverse-engineer, decompile or disassemble the App, except to the extent permitted by mandatory law;
- rent, lease, sublicense, distribute or resell the App;
- remove or alter proprietary notices;
- obtain someone else's chats without authorisation to access their device or account;
- use the App to harass, threaten or stalk anyone, or to violate anyone's privacy, secrecy of communications or other rights;
- present exported files or integrity reports as false evidence;
- use the App in a way that violates applicable law, a messaging service's terms or Apple's terms.
We may suspend or terminate your licence if you materially breach these Terms.
6. Your content and responsibilities
You keep all rights to your archive, exports and backups. You grant us only the limited, on-device licence necessary to operate the features you invoke. Because processing happens on your device, we never receive your content.
You are responsible for:
- confirming you are entitled to keep, process, export and share the content in the archive, including other people's personal information;
- complying with local law on communications records, privacy and data protection;
- reviewing messages rebuilt from screenshots and verifying accuracy before important use;
- keeping your backup passphrase safe and storing backups somewhere you trust;
- keeping your device passcode safe, especially with the app lock on.
7. Purchases
This version has no in-app purchases and is free. We process no payments, and there are no subscriptions or restores. If paid features are introduced later, the price and terms will be shown in the App before you confirm a purchase.
8. Free features
All current features are free with no usage limits.
9. Intellectual property and trademarks
The App, including its software, design, text and graphics, is owned by the Developer or its licensors and is protected by copyright and other laws. These Terms do not grant you any rights other than the limited licence in §5.
"Msg Archive" is a name used by us. WhatsApp, iMessage, SMS and other messaging service names and logos are trademarks of their respective owners. The App is an independent product, not affiliated with, sponsored or endorsed by any messaging service. Content in an archive, including avatars, images and text, belongs to its respective owners.
Apple, iPhone and App Store are trademarks of Apple Inc.
10. Feedback
If you send us suggestions or feedback, you grant us a non-exclusive, perpetual, royalty-free, worldwide licence to use and incorporate it without compensation or attribution. Do not send us real conversations.
11. Privacy
Our Privacy Policy explains what the App processes on your device and what leaves it. By using the App you acknowledge that policy. The key point: messages never leave this device unless you export or share them.
12. Disclaimer of warranties
To the maximum extent permitted by law, the App is provided "AS IS" and "AS AVAILABLE", without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, non-infringement, and uninterrupted or error-free operation.
We do not warrant that:
- an import or recognition result will be complete, accurate or identical to the original chat;
- an export will have any legal effect or be accepted by any authority;
- a backup will always be restorable, or that no data will be lost;
- the App will be compatible with every iOS version or export format.
Some jurisdictions do not allow the exclusion of certain warranties, so some of the above may not apply to you.
13. Limitation of liability
To the maximum extent permitted by law, the Developer will not be liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for any loss of data, archives, messages, profits, goodwill or business opportunity, arising out of or related to your use of or inability to use the App, even if advised of the possibility.
To the maximum extent permitted by law, the Developer's total aggregate liability for all claims relating to the App will not exceed the greater of (a) the amount you paid for the App in the 12 months preceding the claim, or (b) USD 10.
Nothing in these Terms limits liability that cannot be limited by law, or your mandatory statutory rights as a consumer.
14. Indemnity
To the extent permitted by law, you agree to indemnify and hold harmless the Developer from claims, damages, losses and expenses (including reasonable legal fees) arising from your breach of these Terms, your misuse of the App, or your archiving or exporting of another person's communications without the right to do so.
15. Termination
You may stop using the App and delete it at any time. We may suspend or terminate the licence if you breach these Terms or if we discontinue the App. On termination, the licence in §5 ends; §§4, 9, 12, 13, 14, 17 and 18 survive. Termination does not entitle you to a refund except where required by law or by Apple's refund policy.
16. Changes to the App and these Terms
We may update the App and these Terms from time to time. We will post the updated Terms with a new "Last updated" date and, for material changes, describe them in the App or on this page before they take effect. If you continue to use the App after the effective date, you accept the updated Terms.
17. Governing law and disputes
These Terms are governed by the laws of the People's Republic of China, without regard to conflict-of-law rules. Subject to the paragraph below, the courts of the People's Republic of China have exclusive jurisdiction over disputes arising from these Terms or the App.
Nothing in this section deprives you of the protection of mandatory consumer laws in your country of residence, or of your right to bring a claim in your local courts where the law gives you that right. Before filing a claim, please contact us at support@gougou.me so we can try to resolve the issue informally.
18. Miscellaneous
- Entire agreement. These Terms and the Privacy Policy are the entire agreement between you and us regarding the App.
- Severability. If any provision is held invalid, the remaining provisions remain in full force.
- No waiver. Our failure to enforce a provision is not a waiver.
- Assignment. You may not assign these Terms. We may assign them to an affiliate or successor.
- Language. These Terms are provided in English and Chinese. If they conflict, the English version controls to the extent permitted by applicable law.
- Apple. Apple is not a party to these Terms except as stated in §4.
